Warranty Statement

Pulse Systems represents and warrants all Products manufactured by Pulse Systems to be free from defects in workmanship and material for a period of one year from the date of shipment, when owned by the original purchaser. The original purchaser must obtain a return authorization number (RMA) from Pulse Systems prior to returning product to Pulse. The freight is to be prepaid by the original purchaser to and from our facility for all returns. During the warranty period, Pulse Systems will at its option repair or replace parts that prove to be defective.

Should Pulse Systems be unable to repair the equipment within a reasonable amount of time, a refund will be considered covering labor and material involved. The use and the manner of use of Pulse Systems products shall be the responsibility of the customer. The customer covenants and agrees to indemnify and save harmless Pulse Systems, Inc. in respect to any loss or damage that may arise through the use by the customer or others, of any of Pulse Systems' products.

This warranty does not however apply when the defect has been caused through:

• Improper installation; wrong installation or assembly or failure to service the Product or otherwise follow Pulse’s service instructions including any repairs or installation or assembly or service made by unauthorized personnel not approved by Pulse Systems or replacements with parts not manufactured or supplied by Pulse Systems Inc.;
• Misuse or other unsuitable or unauthorized use of the Product or negligence or error in storing, maintaining or in handling the Product or any equipment thereof;
• Unauthorized modification or misuse. Modifications or changes of the Product as well as any adding to it without Pulse’s prior authorization;
• Operation outside the environmental specification of the equipment;
• Natural disaster such as, but not limited to, lightning, flood, winds that exceed specified values, acts of war, civil unrest, vandalism, theft, etc.
• Other factors depending on the Customer.

Notwithstanding the aforesaid Pulse’s liability under this clause shall not apply to any defects arising out of materials, designs or instructions provided by the Customer.

This warranty is expressly in lieu of and excludes all other conditions, warranties and liabilities, express or implied, whether under law, statue or otherwise, including without limitation any implied warranties of merchantability or of fitness for a particular purpose and all other obligations and liabilities of Pulse systems or its representatives with respect to any defect or deficiency applicable to or resulting directly or indirectly from the Products supplied hereunder, which obligations and liabilities are hereby expressly canceled and waived. Pulse’s liability shall under no circumstances exceed the invoice price of any Product for which a warranty claim is made, nor shall Pulse Systems in any circumstance be liable for lost profits or other consequential loss whether direct or indirect or for special damages.

Repair Warranty

**NOTE: The warranty for repair items, where Pulse Systems is not the original manufacturer of the equipment, is one year from the date of shipment and this warranty extends only to the actual repair performed by Pulse Systems (Exclusion & Comments above apply).
